Purpose of the Bill : This Act would allow the Court of Common Pleas to provide incentives for participation in a Driving Under the Influence (DUI) Treatment Program. It is anticipated that this program, which will last a minimum of 9 months, will address offenders who have serious alcohol abuse problems. The offenders will plead guilty and be sentenced to participate in the program which will include Ignition Interlock License devices, strict supervision, transdermal patches, and most importantly evidence based alcohol and/or substance abuse treatment. The incentives will be that the offender will be able to seek an Ignition Interlock License while participating. In addition upon successful completion the offender can seek reinstatement of license. Finally, in order to get the offender in treatment quickly, the 60 day level V sentence may be imposed with a delayed reporting date and suspended upon successful completion of the DUI Treatment Program. Second offenders will in most cases begin their sentence and participation in DUI Treatment Program on Home Confinement or where appropriate at Work Release.
